1. Agreement to these Terms
These Terms of Service (the "Terms") are a binding agreement between you and Falcon Forge, LLC ("Falcon Forge," "we," "us" or "our") governing your access to and use of the website at falconforge.org and its pages in English and Arabic (the "Site").
By accessing or using the Site you confirm that you have read, understood and agree to these Terms and to our Privacy Policy. If you use the Site on behalf of an organization, you confirm that you are authorized to accept these Terms for it. If you do not agree, do not use the Site.
2. Who we are
Falcon Forge, LLC is a limited liability company organized in the United States and based in Greenville, South Carolina. We deliver defense acquisition training, leadership programs and the Chiron Platform in support of Saudi Vision 2030.
3. The Site and the Chiron Platform
The Site is an informational website. It describes our programs, our people and the Chiron Platform, and it lets you contact us.
The Chiron Platform at chiron.falconforge.org, and any training, courses, certificates or other services we provide, are governed by the written agreements we sign with the organizations we serve and by any terms presented inside the platform. If those agreements or terms conflict with these Terms, they control for the services they cover.
4. Acceptable use
You may use the Site only for lawful purposes and in line with these Terms. You agree not to:
- use the Site in any way that breaks an applicable law or regulation, in the United States, the Kingdom of Saudi Arabia or anywhere else;
- attempt to gain unauthorized access to the Site, the Chiron Platform, our servers or any connected system, or probe, scan or test their vulnerability;
- interfere with or disrupt the Site, including by introducing malicious code or by sending automated, excessive or abusive requests;
- copy, scrape or harvest content or data from the Site by automated means, other than through recognized search engines indexing public pages;
- use the Site's content to build a competing training product, course library or dataset;
- impersonate any person or organization, or misrepresent your affiliation with one;
- send us spam, unsolicited advertising or content that is unlawful, defamatory, threatening or infringing.
5. Intellectual property
The Site and its content, including text, graphics, photographs, logos, icons, page layouts and software, are owned by Falcon Forge or its licensors and are protected by copyright, trademark and other laws.
"Falcon Forge," the falcon mark, "Chiron" and "Al-Hakim," and their Arabic equivalents, are trademarks of Falcon Forge. You may not use them without our prior written permission.
We grant you a limited, revocable, non-exclusive, non-transferable license to view the Site and to print or save reasonable portions of it for your own internal, non-commercial reference, provided you keep all copyright and other notices intact. Any other use requires our written consent.
6. Names, logos and references of others
The Site refers to governments, ministries, armed services, universities, standards bodies and other organizations, and may show their names, seals or logos, to identify them and to describe our experience, our people's backgrounds and the standards our courses are built to.
These references are descriptive only. They do not mean that any of these organizations endorses, sponsors or is affiliated with Falcon Forge unless we say so expressly. Statements that our courses are equivalent to, or aligned with, the Warfighting Acquisition University (WarU) standard are our own assessment of curriculum alignment and are not an accreditation or endorsement by that university or by any government. All third-party trademarks belong to their owners.
7. Information you send us
When you use the contact form, apply to become a provider, or email us, you agree that the information you provide is accurate and that you have the right to share it. We handle personal information as described in our Privacy Policy.
Do not send us classified information, export-controlled technical data, or any information you are obliged to keep confidential. The Site's forms are not designed for it and we will not treat unsolicited submissions as confidential unless we have agreed to in writing.
You grant us permission to use what you send in order to respond to you and to consider your inquiry or application. Sending us an idea or proposal does not create any obligation for us to use it, pay for it or keep it confidential.
8. No offer and no professional advice
The content of the Site is general information about Falcon Forge. It is not an offer, a bid, a quotation or a contract, and it is not legal, financial, procurement or other professional advice. Program descriptions, course counts, tracks, timelines and availability may change without notice.
Any engagement with Falcon Forge requires a written agreement signed by an authorized representative of each party.
9. Export controls and sanctions
You agree to comply with all export control and economic sanctions laws that apply to your use of the Site, including the laws of the United States (such as the Export Administration Regulations, the International Traffic in Arms Regulations and sanctions administered by the Office of Foreign Assets Control) and of the Kingdom of Saudi Arabia.
The public Site does not contain export-controlled technical data. You may not use the Site if you are a person with whom U.S. persons are prohibited from dealing.
10. Third-party links and services
The Site may link to, or load small resources such as icons from, websites and services operated by others. We do not control them and are not responsible for their content, availability or privacy practices. A link is not an endorsement. Your use of another website is governed by its own terms.
11. Availability and changes to the Site
We may change, suspend or discontinue any part of the Site at any time, without notice and without liability. We do not promise that the Site will always be available, uninterrupted or error-free.
12. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE AND NON-INFRINGEMENT.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FALCON FORGE AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
14. Indemnification
You agree to defend, indemnify and hold harmless Falcon Forge and its members, officers, employees, contractors and agents from any claim, loss, liability or expense, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site.
15. Governing law and disputes
These Terms are governed by the laws of the State of South Carolina, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Greenville County, South Carolina, have exclusive jurisdiction over any dispute arising from these Terms or the Site, and you consent to their jurisdiction.
Before starting any proceeding, please contact us so we can try to resolve the matter informally. Nothing in this section removes any right you have under mandatory law where you live.
16. Changes to these Terms
We may update these Terms from time to time. The date at the top of this page shows when they last changed. Changes take effect when posted. By continuing to use the Site after a change, you accept the updated Terms.
17. General
These Terms, together with our Privacy Policy, are the entire agreement between you and Falcon Forge about the Site. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a reorganization, merger or sale of assets.
These Terms are published in English and Arabic. If the two versions differ, the English version controls.
